by using xpacks you accept all of the following.
1. acceptance. by using this site, connecting a wallet, earning, buying or opening a pack, trading a card, or interacting with any part of the platform, you agree to these terms in full. if you do not agree, do not use the platform. the terms may change at any time without notice, and continued use is acceptance of the current version.
2. what a card is. cards, packs, grades, tiers, cert numbers and every other on-site element are features of an experimental software artifact and a collectible game. a card is a limited, revocable license to a game item attributed to your wallet, and a 1-of-1 collectible NFT. it is not property, equity, a security, an investment contract, or a claim on any person, revenue or asset. words like "own", "buy", "sell", "burn" and "pack" are shorthand and convey no legal interest of any kind. nothing here is an offering of securities.
3. payments are final. all payments, burns and mints are on-chain solana transactions. blockchain transactions are irreversible, and to the maximum extent permitted by law all payments are final and non-refundable — regardless of mistakes, dissatisfaction, price movement, changes to the platform, or anything else. you are responsible for network fees and for using the correct wallet. tokens burned are gone and are never refunded. you send marketplace payment before the platform verifies and settles it; a payment that cannot be matched to a completed card transfer — because a listing changed or verification failed — is still final and non-refundable, and the platform is not obligated to reverse it.
4. odds, supply and the machine. tier odds, pack counts, burn pricing, pack pricing, the grading model and the pool of moments are set and operated at the platform's sole discretion and may be changed, rebalanced, paused or discontinued at any time. availability of the machine, any tier, or any particular card or grade is never guaranteed and creates no entitlement to open or to a refund. pack issuance is capped at 1024 burn packs and 1024 buy packs and stops when an allotment is exhausted; qualifying for a pack creates no entitlement to one once the allotment is gone.
5. NFTs and minting. minting is an automatic on-chain action; the solana network determines when it confirms, and that timing is not guaranteed. your card is yours in the game the moment you pull it. no specific metadata host, marketplace listing or resale value is guaranteed, and the platform is not responsible for how any third-party wallet, explorer or marketplace displays a card.
6. content and grading. moments are public posts pulled from third-party sources and shown for commentary and collectible purposes; xpacks is not affiliated with, endorsed by, or connected to 𝕏, xAI, or any person featured on a card. grades are produced automatically by grok and are opinion, not fact. for a "grade your own tweet" pull you represent that you own or have the rights to the post you submit and that it infringes no third party's rights, you are solely responsible for it, and you grant the operators a license to display and process it as part of running the platform. the operators may remove content and honor takedown requests at their discretion.
7. fair play. the game is server-authoritative. attempts to exploit, automate, double-spend, forge signatures, or otherwise cheat may void packs, cards, credits and pending actions, and may permanently exclude a wallet. these determinations are made at the platform's sole and final discretion, without notice and without appeal.
8. the token. any token associated with xpacks has no intrinsic value and no promise attached beyond its in-game role of earning packs. its market price is set entirely by third parties and may go to zero at any time. the operators make no representations about its price, liquidity or future.
9. risk. you use the platform entirely at your own risk. xpacks is experimental software and may contain bugs, defects, errors and failures of any kind, at any time and without warning. those bugs, together with the ordinary hazards of crypto (blockchains that halt, congest or fork; wallets that are compromised; keys that are lost; RPC, smart-contract, network or third-party failures; and changing rules and regulators) can cause the partial or total, permanent and irreversible loss of your SOL, tokens, NFTs, cards, packs, or anything else of value. none of this is the operators' fault in any way, and none of it is the operators' responsibility in any way. the operators do not guarantee that the platform is free of bugs, that it will function correctly, or that anything lost through it can be recovered. by using the platform you accept this risk in full, and you agree that any such loss, of crypto, NFTs, or anything else, is yours alone to bear.
10. eligibility. you represent that you are at least 18, or the age of majority where you live; that you are not located in, resident in, or accessing the platform from any jurisdiction where crypto tokens or randomized paid game mechanics are prohibited or restricted; and that your use breaks no law that applies to you. the platform is not offered where prohibited. case-opening is an entertainment mechanic, not a wager for money, and packs, cards and grades have no cash value from the operators.
11. randomness. tier outcomes follow the published odds and are generated by the platform's servers. rolls, tiers and grades are final.
12. card ownership. card ownership is recorded and enforced by the platform's servers. a marketplace transaction settles SOL directly between wallets and reassigns the in-game card record. where a card's NFT was escrowed to the vault at listing, on-chain delivery of that NFT to the buyer (and its return on unlisting) is an automatic queued action like minting; on-chain confirmation timing is not guaranteed, and the in-game record is authoritative in the meantime.
13. general. you agree to indemnify and hold the operators harmless from any claim arising out of your use of the platform, your content, or your breach of these terms. if any part of these terms is unenforceable, the rest stays in force. these terms are the entire agreement between you and the operators about the platform, and no failure to enforce any part is a waiver of it.
the platform and everything on it are provided "as is" and "as available", without warranty of any kind. to the maximum extent permitted by law, the operators are not liable for any damages of any kind arising from use of the platform, and their total aggregate liability shall not exceed zero. nothing on this site is financial, investment, tax or legal advice. the platform may be modified, suspended or discontinued, in whole or in part, at any time, without notice.
